JSC interviews candidates for competition tribunal chairperson position

The Judicial Service Commission (JSC) has launched interviews for candidates seeking appointment as Chairperson of the Competition Tribunal, continuing its drive to bolster Kenya’s specialized dispute resolution institutions.

The recruitment exercise forms part of the Commission’s wider strategy to improve the efficiency and effectiveness of tribunals that handle complex commercial and regulatory disputes.

Competition Tribunal Plays Key Oversight Role

According to the JSC, the Competition Tribunal is responsible for hearing appeals and reviewing decisions made by the Competition Authority of Kenya (CAK), making it a vital institution in safeguarding fair competition and protecting consumer interests.

The tribunal provides an independent platform for resolving disputes arising from the enforcement of Kenya’s competition laws.

Recruitment Follows Other Tribunal Interviews

The latest interviews come shortly after the Commission concluded the recruitment of candidates for two other specialized judicial bodies.

Earlier this week, JSC interviewed applicants for the positions of Chairperson of the Industrial Property Tribunal and Chairperson of the Energy and Petroleum Tribunal.

The Industrial Property Tribunal handles disputes involving patents, industrial designs, utility models, semiconductor technologies and other intellectual property matters.

Meanwhile, the Energy and Petroleum Tribunal hears appeals against decisions made by the Energy and Petroleum Regulatory Authority (EPRA) and resolves disputes involving players within the energy and petroleum industries.

JSC Seeks to Strengthen Specialized Justice

In a statement, the Commission said the ongoing recruitment exercise reflects its commitment to enhancing specialized tribunals that support the administration of justice across various sectors.

“Through these recruitment processes, the Commission continues to strengthen specialized tribunals that play a critical role in the administration of justice and the resolution of sector-specific disputes,” the JSC said.

Supporting Business and Investor Confidence

The Commission noted that specialized tribunals are essential in resolving technical disputes promptly while complementing the work of the Judiciary.

Their decisions help enhance regulatory certainty, safeguard the rights of consumers and investors, and promote a predictable legal environment that supports economic growth.

By ensuring disputes are handled by institutions with sector-specific expertise, the tribunals contribute to improving confidence in Kenya’s regulatory and judicial systems.

Part of JSC’s Constitutional Mandate

The interviews are being conducted under the Judicial Service Commission’s constitutional responsibility to recruit qualified leaders for judicial and quasi-judicial institutions.

According to the Commission, appointing competent leadership to specialized tribunals is critical to maintaining an independent, efficient and accountable justice system capable of responding to the country’s evolving legal and economic landscape.
