The High Court in Kibera has ordered Kenyatta National Hospital (KNH) to release, within a fortnight, the mental assessment report of Kithuka Kimunyi Musyimi, the prime suspect in last October’s killing of a GSU officer at State House in Nairobi.
Justice Diana Kavedza in a Wednesday ruling said the report was crucial in determining whether the accused person was mentally fit to take a plea on the murder charge.
The accused person has been in custody since his arrest over the crime within State House’s highly secured Gate D along Dennis Pritt Road. He is said to have fired arrows, one of them striking Constable Ramadhan Khamisi Matanka, who succumbed later at the national referral hospital.
The delayed release of the mental assessment report had disrupted earlier proceedings after concerns were raised over Musyimi’s state of mind.
The prosecution told the court that despite multiple follow-ups, the hospital had not made the report available, prompting the court’s firm orders.
Justice Kavedza said absence of the report had resulted in repeated postponements of the case and consequently ordered the Office of the Director of Public Prosecutions (ODPP) and KNH to ensure the psychiatric evaluation is completed and submitted by the set deadline.
The accused will remain in custody at Nairobi Remand Prison pending filing of the report whose finding will help the court establish whether he is fit to stand trial and enter a plea to the murder charge.
The plea-taking has been scheduled for February 9, 2025, to allow time for the report to be filed.
